3. Hosting über Cloudflare Pages

Diese Website wird über den Dienst Cloudflare Pages der Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA („Cloudflare“) bereitgestellt. Cloudflare betreibt ein weltweites Servernetz (Content Delivery Network). Beim Aufruf der Website verarbeitet Cloudflare technisch notwendige Daten, insbesondere Ihre IP-Adresse, Datum und Uhrzeit des Zugriffs, die aufgerufene Seite, den Referrer (zuvor besuchte Seite), Browsertyp und Betriebssystem (User-Agent). Diese Daten werden in Server-Logfiles verarbeitet, um die Website auszuliefern, ihre Stabilität und Sicherheit zu gewährleisten und Angriffe (z. B. DDoS) abzuwehren. Wir selbst werten diese Daten nicht zur Analyse des Nutzerverhaltens aus.

Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO. Unser berechtigtes Interesse liegt in einer sicheren, schnellen und zuverlässigen Bereitstellung der Website. Mit Cloudflare besteht ein Vertrag zur Auftragsverarbeitung (Art. 28 DSGVO). Dabei kann es zu einer Übermittlung von Daten in die USA kommen. Cloudflare ist unter dem EU-US Data Privacy Framework zertifiziert (Angemessenheitsbeschluss der EU-Kommission, Art. 45 DSGVO); ergänzend gelten die EU-Standardvertragsklauseln (Art. 46 Abs. 2 lit. c DSGVO). 4. Keine Cookies, keine Analyse

Wir setzen auf dieser Website keine Cookies und keine vergleichbaren Technologien ein und nutzen keine Webanalyse-, Werbe- oder Social-Media-Plugins. Eine Einwilligung nach § 25 TDDDG ist daher nicht erforderlich. Links zu Instagram oder Kit sind einfache Verlinkungen. Erst wenn Sie darauf klicken, gelangen Sie auf die Seiten dieser Anbieter, für die deren Datenschutzhinweise gelten bzw. die nachfolgenden Abschnitte.

5. Kostenloser Leitfaden und E-Mail-Newsletter (Kit)

Sie können sich für unseren kostenlosen PDF-Leitfaden („10 Calm Scripts for Toddler Tantrums“) und unseren E-Mail-Newsletter anmelden. Der Newsletter enthält Tipps und Formulierungshilfen rund um die Erziehung von Kleinkindern sowie Informationen zu unseren eigenen digitalen Produkten.

Anbieter: Für Anmeldeseite und Versand nutzen wir Kit, Inc. (vormals ConvertKit LLC), P.O. Box 761, Boise, ID 83701, USA („Kit“). Die Anmeldeseite wird von Kit bereitgestellt.

Verarbeitete Daten: E-Mail-Adresse, ggf. Vorname, Zeitpunkt der Anmeldung und der Bestätigung, IP-Adresse sowie die Information, über welche Seite Sie sich angemeldet haben.

Double-Opt-in: Nach der Anmeldung erhalten Sie eine E-Mail, in der Sie Ihre Anmeldung bestätigen. Erst danach werden Sie in den Verteiler aufgenommen. Die Anmeldung und Bestätigung protokollieren wir, um die Einwilligung nachweisen zu können.

Erfolgsmessung: Unsere E-Mails enthalten ein kleines Zählpixel und Links, über die Kit erfasst, ob und wann eine E-Mail geöffnet und welche Links angeklickt wurden. Diese Auswertung dient dazu, den Versand zu prüfen und die Inhalte zu verbessern. Sie ist Teil Ihrer Einwilligung in den Newsletter-Empfang.

Rechtsgrundlage ist Ihre Einwilligung (Art. 6 Abs. 1 lit. a DSGVO; § 7 Abs. 2 Nr. 2 UWG; für die Erfolgsmessung zusätzlich § 25 Abs. 1 TDDDG). Die Protokollierung der Anmeldung beruht auf Art. 6 Abs. 1 lit. f DSGVO (Nachweis der Einwilligung).

Abmeldung / Widerruf: Sie können Ihre Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen, über den Abmeldelink am Ende jeder E-Mail oder per Nachricht an [email protected]. Die Rechtmäßigkeit der bis zum Widerruf erfolgten Verarbeitung bleibt unberührt.

Speicherdauer: Ihre Daten werden gespeichert, bis Sie sich abmelden. Nach der Abmeldung kann Ihre E-Mail-Adresse in einer Sperrliste gespeichert werden, damit Sie keine weiteren E-Mails erhalten (Art. 6 Abs. 1 lit. f DSGVO).

Auftragsverarbeitung und Drittlandübermittlung: Mit Kit besteht ein Vertrag zur Auftragsverarbeitung (Art. 28 DSGVO). Ihre Daten werden in den USA verarbeitet. Die Übermittlung erfolgt auf Grundlage der EU-Standardvertragsklauseln, die Bestandteil des Auftragsverarbeitungsvertrags von Kit sind (Art. 46 Abs. 2 lit. c DSGVO). 6. Instagram und automatische Direktnachrichten (ManyChat)

Wir betreiben das Instagram-Profil @sayitcalmer. Instagram ist ein Dienst der Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Irland („Meta“). Wenn Sie unser Profil besuchen, mit Beiträgen interagieren oder uns schreiben, verarbeitet Meta Ihre Daten nach der eigenen Datenschutzrichtlinie: privacycenter.instagram.com/policy. Meta stellt uns zudem anonymisierte Statistiken zur Reichweite unseres Profils bereit („Insights“). Für diese Statistiken sind wir gemeinsam mit Meta verantwortlich (Art. 26 DSGVO). Meta hat die Hauptverantwortung für die Verarbeitung übernommen und ist erste Anlaufstelle für Ihre Betroffenenrechte.

Für automatische Antworten nutzen wir den Dienst ManyChat der Manychat, Inc., 535 Mission Street, San Francisco, CA 94105, USA („ManyChat“). Wenn Sie unter einem Beitrag ein Stichwort kommentieren (z. B. „CALM“) oder uns eine Direktnachricht senden, erhält ManyChat über die offizielle Schnittstelle von Meta folgende Daten: Ihren Instagram-Nutzernamen und Ihre Nutzer-ID, Ihren öffentlichen Profilnamen und ggf. Ihr Profilbild, den Inhalt Ihres Kommentars bzw. Ihrer Nachricht, Zeitpunkte sowie Angaben, die Sie uns im Chat freiwillig mitteilen (z. B. Ihre E-Mail-Adresse). ManyChat sendet Ihnen daraufhin automatisch eine Direktnachricht, z. B. mit dem Link zu unserem kostenlosen Leitfaden.

Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO (Bearbeitung Ihrer Anfrage) sowie Art. 6 Abs. 1 lit. f DSGVO (unser berechtigtes Interesse an einer schnellen, automatisierten Beantwortung). Geben Sie im Chat Ihre E-Mail-Adresse für den Newsletter an, gilt Abschnitt 5 (Einwilligung). Mit ManyChat besteht ein Vertrag zur Auftragsverarbeitung (Art. 28 DSGVO). ManyChat verarbeitet Daten in den USA und ist unter dem EU-US Data Privacy Framework zertifiziert (Art. 45 DSGVO); ergänzend gelten EU-Standardvertragsklauseln. Wir speichern die Daten in ManyChat, solange dies für die Kommunikation mit Ihnen erforderlich ist. Sie können jederzeit die Löschung verlangen oder der Verarbeitung widersprechen, z. B. mit einer kurzen Nachricht („STOP“) im Chat oder per E-Mail. Weitere Informationen: manychat.com/legal/privacy.

7. Kontakt per E-Mail

Wenn Sie uns an [email protected] schreiben oder auf einen Newsletter antworten, verarbeiten wir Ihre E-Mail-Adresse, Ihren Namen (falls angegeben) und den Inhalt Ihrer Nachricht, um Ihre Anfrage zu beantworten. E-Mails an diese Adresse werden über den Dienst Cloudflare Email Routing (Cloudflare, Inc., siehe Abschnitt 3) an ein E-Mail-Postfach bei Google (Gmail) weitergeleitet. Anbieter ist die Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland („Google“). Cloudflare leitet die Nachrichten nach eigenen Angaben nur weiter und speichert ihren Inhalt nicht dauerhaft. Bei Cloudflare und Google kann es zu einer Übermittlung von Daten in die USA kommen. Beide Unternehmen bzw. ihre US-Muttergesellschaften sind unter dem EU-US Data Privacy Framework zertifiziert (Art. 45 DSGVO).

Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO, sofern Ihre Anfrage mit einem Vertrag oder vorvertraglichen Maßnahmen zusammenhängt, ansonsten Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an der Beantwortung von Anfragen). Wir löschen Ihre Nachricht, sobald Ihr Anliegen erledigt ist, sofern keine gesetzlichen Aufbewahrungspflichten entgegenstehen.

8. Ihre Rechte

Sie haben nach der DSGVO folgende Rechte gegenüber uns:

  • Recht auf Berichtigung (Art. 16 DSGVO)

Widerspruchsrecht (Art. 21 DSGVO): Soweit wir Daten auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO verarbeiten, können Sie aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit Widerspruch gegen die Verarbeitung einlegen. Der Verarbeitung zu Zwecken der Direktwerbung können Sie jederzeit ohne Angabe von Gründen widersprechen.

9. Beschwerderecht bei einer Aufsichtsbehörde

2. Summary

  • This website sets no cookies and uses no analytics or tracking tools.
  • Fonts and images are loaded directly from our own server. No third-party content (e.g. Google Fonts) is embedded.
  • We only process personal data where necessary to run the website, send our free guide and newsletter, and reply to messages on Instagram or by email.

3. Hosting via Cloudflare Pages

This website is delivered through Cloudflare Pages, a service of Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA ("Cloudflare"), which operates a global content delivery network. When you visit the website, Cloudflare processes technically necessary data, in particular your IP address, date and time of access, the page requested, the referrer, and your browser type and operating system (user agent). This data is processed in server log files in order to deliver the website, keep it stable and secure, and defend against attacks (e.g. DDoS). We do not use this data to analyse user behaviour.

The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is the secure, fast and reliable provision of the website. We have a data processing agreement with Cloudflare (Art. 28 GDPR). Data may be transferred to the USA. Cloudflare is certified under the EU-U.S. Data Privacy Framework (European Commission adequacy decision, Art. 45 GDPR); EU Standard Contractual Clauses apply in addition (Art. 46(2)(c) GDPR). 4. No cookies, no analytics

This website does not use cookies or similar technologies, and we use no web analytics, advertising or social media plugins. Consent under § 25 TDDDG is therefore not required. Links to Instagram or Kit are plain links. Only when you click them are you taken to those providers' pages, where their privacy policies and the sections below apply.

5. Free guide and email newsletter (Kit)

You can sign up for our free PDF guide ("10 Calm Scripts for Toddler Tantrums") and our email newsletter. The newsletter contains tips and phrasing ideas for parenting toddlers as well as information about our own digital products.

Provider: We use Kit, Inc. (formerly ConvertKit LLC), P.O. Box 761, Boise, ID 83701, USA ("Kit") for the sign-up page and for sending emails. The sign-up page is hosted by Kit.

Data processed: email address, first name (if provided), time of sign-up and confirmation, IP address, and the page through which you signed up.

Double opt-in: After signing up you receive an email asking you to confirm. Only then are you added to the list. We log sign-up and confirmation so we can prove your consent.

Performance tracking: Our emails contain a small tracking pixel and tracked links that let Kit record whether and when an email was opened and which links were clicked. We use this to check delivery and improve our content. It is part of your consent to receive the newsletter.

Legal basis is your consent (Art. 6(1)(a) GDPR; § 7(2) no. 2 UWG; for tracking also § 25(1) TDDDG). Logging the sign-up is based on Art. 6(1)(f) GDPR (proof of consent).

Unsubscribing / withdrawal: You can withdraw your consent at any time with effect for the future via the unsubscribe link at the bottom of every email or by writing to [email protected]. This does not affect the lawfulness of processing before withdrawal.

Retention: Your data is stored until you unsubscribe. After unsubscribing, your email address may be kept on a suppression list so that you receive no further emails (Art. 6(1)(f) GDPR).

Processing agreement and international transfer: We have a data processing agreement with Kit (Art. 28 GDPR). Your data is processed in the USA. The transfer is based on the EU Standard Contractual Clauses included in Kit's data processing addendum (Art. 46(2)(c) GDPR). More information: kit.com/privacy.

6. Instagram and automated direct messages (ManyChat)

We run the Instagram profile @sayitcalmer. Instagram is a service of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland ("Meta"). When you visit our profile, interact with posts or message us, Meta processes your data under its own policy: privacycenter.instagram.com/policy. Meta also gives us anonymised statistics about our profile's reach ("Insights"). For these statistics we are joint controllers with Meta (Art. 26 GDPR). Meta has assumed primary responsibility and is the first point of contact for your data subject rights.

For automated replies we use ManyChat, a service of Manychat, Inc., 535 Mission Street, San Francisco, CA 94105, USA ("ManyChat"). When you comment a keyword under a post (e.g. "CALM") or send us a direct message, ManyChat receives the following via Meta's official interface: your Instagram username and user ID, your public profile name and, where applicable, profile picture, the content of your comment or message, timestamps, and any details you choose to share in the chat (e.g. your email address). ManyChat then automatically sends you a direct message, e.g. with the link to our free guide.

The legal basis is Art. 6(1)(b) GDPR (handling your request) and Art. 6(1)(f) GDPR (our legitimate interest in replying quickly and automatically). If you provide your email address in the chat for the newsletter, section 5 (consent) applies. We have a data processing agreement with ManyChat (Art. 28 GDPR). ManyChat processes data in the USA and is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR); EU Standard Contractual Clauses apply in addition. We keep the data in ManyChat as long as needed to communicate with you. You can request deletion or object at any time, e.g. by replying "STOP" in the chat or by email. 7. Contact by email

If you write to [email protected] or reply to a newsletter, we process your email address, your name (if provided) and the content of your message in order to reply. Emails to this address are forwarded via Cloudflare Email Routing (Cloudflare, Inc., see section 3) to a mailbox hosted by Google (Gmail), provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). According to Cloudflare, it only forwards messages and does not permanently store their content. Data may be transferred to the USA by Cloudflare and Google. Both companies or their US parent companies are certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR).

The legal basis is Art. 6(1)(b) GDPR where your request relates to a contract or pre-contractual steps, otherwise Art. 6(1)(f) GDPR (legitimate interest in answering enquiries). We delete your message once your request has been dealt with, unless statutory retention obligations apply.

8. Your rights

Under the GDPR you have the following rights:

  • Right to rectification (Art. 16 GDPR)
  • Right to erasure (Art. 17 GDPR)
  • Right to restriction of processing (Art. 18 GDPR)
  • Right to data portability (Art. 20 GDPR)

Right to object (Art. 21 GDPR): Where we process data on the basis of Art. 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation. You may object to processing for direct marketing purposes at any time without giving reasons.

10. Other information

We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR. You are not obliged to provide personal data, but without an email address we cannot send you the guide or newsletter. Our offers are aimed at parents and other adults, not at children.
